
CHARLESTON, WV (WVNS) — People in the Mountain State will no longer be able to buy soda with SNAP starting January 2026.
According to a press release, the West Virginia Department of Human Services’ (DoHS) Bureau for Family Assistance (BFA) has received federal approval for soda to not be able to be bought using Supplemental Nutrition Assistance Program (SNAP) benefits starting on January 1, 2026.

The press release stated that regular soda, diet soda, and zero-calorie soda are included in the restriction, however, water, juice, milk, and energy drinks will not be affected.

According to the press release, in May 2025, the waiver request was sent to the U.S. Department of Agriculture Food and Nutrition Service (USDA FNS), and was approved USDA Secretary Brooke Rollins and Governor Patrick Morrisey’s signatures on Monday, August 4, 2025.
The press release stated that “all SNAP-authorized retailers in West Virginia are expected to fully comply with this policy. BFA will provide technical assistance and support to SNAP retailers to help implement the new requirements in advance of the January 1, 2026 effective date.”
According to the press release, a statewide survey will be accessible in 2026 as a way to get public comments and input about the soda restriction.
