Gervonta Davis has avoided trial for a domestic violence charge after the alleged victim refused to prosecute.
"This case was dropped as the victim is declining to prosecute per her victim attorney, Lindsey Chase, Esq., and her sentiments we directly confirmed by the Assistant State Attorney handling the prosecution," the Miami-Dade State Attorney's Office told TMZ Sports.
"The witness to the incident, who is the victim’s mother, also failed to cooperate and failed [to appear] after being subpoenaed for a prefile conference on Thursday 8/7. Followed up attempts to contact the witness (mother) via phone were unsuccessful."
Davis was arrested in Miami Beach on July 11 for a misdemeanor battery domestic violence charge after he was accused of hitting his ex-girlfriend and slapping her during an incident on June 15.
According to the complaint, a verbal altercation occurred, which escalated into a physical confrontation. As Davis' ex-girlfriend was removing her children from Davis' car, as instructed to do so by Davis, Davis allegedly struck her in the back of the head and then slapped her on the right side of her face, causing a minor laceration in the inner area of her lip.
Davis' court hearing was supposed to take place July 29 but was delayed by two weeks to Tuesday, where the case was closed by Judge Elizabeth M. Espinosa Marin.
The WBA lightweight champion was expected to rematch Lamont Roach in August after the pair fought to a controversial draw in March, which included Davis' infamous knee controversy. The timeline for Davis' ring return is currently unclear.
