KANSAS CITY, Mo. — A new lawsuit filed on Friday accuses a Family Dollar in Kansas City of negligence leading up to a partial roof collapse.
A 68-year-old man was killed in the collapse near West 37th Street and Broadway Boulevard on Sunday, July 27.
Hearing held, no recall election date of Jackson County Executive set
The lawsuit names Arthur Fels Company, Family Dollar Stores of Missouri, LLC and Family Dollar, Inc.
The woman who filed the lawsuit claims she was shopping at the store when the roof collapsed, falling directly onto her and crushing her.
The lawsuit states that heavy debris that fell on her caused severe and permanent injuries to her entire body.
According to the lawsuit, a car crashed into the store in 2016, knocking down a support pillar in the front of the building. The support pillar was never replaced or repaired.
The lawsuit claims Family Dollar took no steps to repair the building or alert customers to the building’s condition.
The woman is asking for compensation of damages in excess of $25,000, together with interest and costs and for “further relief as the court deems just and proper.” She is also requesting a jury in this case.
