9 Pensacola area restaurants receive major violations in latest inspection

Here's the breakdown of restaurant inspections in Escambia and Santa Rosa counties for the week of Aug. 18-24. Florida's restaurant owners are not required to post restaurant inspection results where guests can see them. So, every week, we provide that information for you.

During the latest round of inspections from the Department of Business and Professional Regulation, four restaurants received an administrative complaint, five restaurants received a high-priority violation and 22 restaurants passed their first inspection with zero violations.

Total violations: One total violation with an administrative complaint

From initial inspection : Intermediate - No plan review submitted and approved - renovations were made or are in progress. Must submit plans and plan review application to DBPR H and R Plan Review office. Plans must be submitted AND approved within 60 days.

Added support units: shed with refrigerator and hot holding units, extra mobile storage with refrigerators and freezers, and one mobile storage with dry storage and equipment. Plan review not updated. This violation must be addressed by June 1st. **Warning**

From follow-up inspection Aug. 18, 2025: Plans have not been updated for added support unit. **Admin Complaint**

Five restaurants receive a high-priority violation

Zaxby’s

121 E. Nine Mile Road

Inspection details: Routine Inspection on Aug. 19

Follow-up inspection: Violations require further review, but are not an immediate threat to the public. A follow-up inspection is still required.

Total violations: Five total violations, with three high-priority violations

  • High Priority - Stop Sale issued on time/temperature control for safety food due to temperature abuse. Make line reach-in coolers: shredded cheese 44 degrees Fahrenheit for undetermined amount of time, raw chicken tenders 46 degrees Fahrenheit for undetermined amount of time, Asian coleslaw at 46 degrees Fahrenheit ambient cooling for 3.5 hours in central make line reach-in cooler. Compared to other items' temperatures, Asian coleslaw did not appear to be cooling down in time. Instructed operators to use ice to help Asian coleslaw rapidly chill. After 30 minutes, temperature only made it to 45 degrees Fahrenheit.

  • High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. In make line reach-in coolers: salad lettuce 46 degrees Fahrenheit  for two hours, shredded cheese 44 degrees Fahrenheit  for undetermined amount of time, raw chicken tenders 46 degrees Fahrenheit for undetermined amount of time. See stop sale. **Warning**

  • High Priority - Time/temperature control for safety food prepared from/mixed with ingredient(s) at ambient temperature not cooled to 41 degrees Fahrenheit within four hours. Asian coleslaw at 46 degrees Fahrenheit ambient cooling for 3.5 hours in central make line reach-in cooler. Compared to other items' temperatures, Asian coleslaw did not appear to be cooling down in time. Instructed operators to use ice to help Asian coleslaw rapidly chill. After 30 minutes, temperature only made it to 45 degrees Fahrenheit. See stop sale. **Warning**

Burger King

4120 Highway 90, Pace

Inspection details: Routine Inspection on Aug. 18

Follow-up inspection: Violations required further review, but were not an immediate threat to the public. The restaurant complied with a follow-up inspection on Aug. 19 and met inspection standards.

Total violations: Two total violations, with one high-priority violation

  • High Priority - Live, small flying insects found. Upon inspection, observed one flying insect in dining room area of establishment and also one flying insect present in rear of establishment. **Warning**

Hardee’s

6527 Highway 90, Milton

Inspection details: Routine Inspection on Aug. 20

Follow-up inspection: Violations required further review, but were not an immediate threat to the public. The restaurant complied with a follow-up inspection on Aug. 21.

Total violations: Four total violations, with one high-priority violation

  • High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. Upon inspection, observed sliced American cheese 57 degrees Fahrenheit and shredded cheddar 60 degrees Fahrenheit on make line in kitchen. Manager stated less than 30 minutes. Manager had employee move both sliced American cheese and shredded cheddar to colder holding unit for cooling. **Corrective Action Taken**

IHop

5129 Highway 90, Pace

Inspection details: Routine Inspection on Aug. 21

Follow-up inspection: Violations required further review, but were not an immediate threat to the public.  The restaurant complied with a follow-up inspection on Aug. 22.

Total violations: Three total violations, with three high-priority violations

  • High Priority - Raw animal food stored over/not properly separated from ready-to-eat food. Upon inspection, observed unwashed produce in walk-in cooler over ready to eat foods. Manager moved unwashed produce to below ready to eat foods during inspection. **Corrected On-Site**

  • High Priority - Stop Sale issued on time/temperature control for safety food due to temperature abuse. Upon inspection, observed on server station line cold holding unit, bags of mixed fruit with cut melon at 47 degrees Fahrenheit, vanilla sauce 57 degrees Fahrenheit, individual butter portions 45 degrees Fahrenheit all with time stamp when placed on line of over four hours. Also observed whipped cream at 58 degrees Fahrenheit with no time stamp that employee stated was placed on line approximately the same time as the other items, over four hours.

  • High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. Upon inspection, observed omelette batter with temperature of 52 degrees Fahrenheit (removed from refrigeration approximately 15 minutes ago) and buttermilk batter at 61 degrees Fahrenheit (removed from refrigeration approximately 30 minutes ago) in kitchen area of establishment. Employee and manager moved items to cooler during inspection for cooling. Also observed on server station line cold holding unit, bags of mixed fruit with cut melon at 47 degrees Fahrenheit, vanilla sauce 57 degrees Fahrenheit, individual butter portions 45 degrees Fahrenheit all with time stamp when placed on line of over four hours. Also observed whipped cream at 58 degrees Fahrenheit with no time stamp that employee stated was placed on line approximately the same time as the other items, over four hours. Also observed bags of shredded cheese in same cold holding unit at 48 degrees Fahrenheit (less than four hours). Manager moved bags to colder holding unit for cooling). **Warning**

Inspection details: Complaint Partial Inspection on Aug. 22

Follow-up inspection: Violations require further review, but are not an immediate threat to the public. A follow-up inspection is still required.

Total violations: Four total violations, with one high-priority violation

  • High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. For two hours in walk-in cooler: pre-cut lettuce 49 degrees Fahrenheit, pre-sliced tomatoes 54 degrees Fahrenheit. Upon inspection, walk-in cooler door was ajar. Door does not close completely every time. Per owner, power went out approximately two hours before inspection. Operator moved items to walk-in freezer to rapidly chill. **Corrective Action Taken**

What agency inspects restaurants in Florida?

Routine regulation and inspection of restaurants is conducted by the Department of Business and Professional Regulation. The Department of Health is responsible for investigation and control of food-borne illness outbreaks associated with all food establishments.

How do I report a dirty restaurant in Florida?

If you see abuses of state standards, report them and the Department of Business and Professional Regulation will send inspectors. Call the Florida DBPR at 850-487-1395 or report a restaurant for health violations online.

What does all that terminology in Florida restaurant inspections mean?

Basic violations are those considered against best practices.

A warning is issued after an inspector documents violations that must be corrected by a certain date or within a specified number of days from receipt of the inspection report.

An administrative complaint is a form of legal action taken by the division. Insufficient compliance after a warning, a pattern of repeat violations or existence of serious conditions that warrant immediate action may result in the division initiating an administrative complaint against the establishment. Says the division website: "Correcting the violations is important, but penalties may still result from violations corrected after the warning time was over."

An emergency order — when a restaurant is closed by the inspector — is based on an immediate threat to the public. Here, the Division of Hotels and Restaurants director has determined that the establishment must stop doing business and any division license is suspended to protect health, safety or welfare of the public.

A 24-hour call-back inspection will be performed after an emergency closure or suspension of license.
