Judge Rules NASCAR Team Can't Sell its Charter Just Yet

A North Carolina Superior Court judge has granted Legacy Motor Club’s request for a preliminary injunction to prevent Rick Ware Racing from transferring or selling its two Charters until a lawsuit involving the two NASCAR Cup Series teams is resolved.

Legacy requested the injunction after it became known that T.J. Puchyr, who was one of the founders of Spire Motorsports, planned to buy into RWR and keep both Charters.

Earlier this year, Legacy Motor Club filed a lawsuit that claimed a contract regarding the sale of a RWR Charter to the Statesville, North Carolina-based team was being finalized when RWR decided to back out of the agreement. RWR then filed a countersuit that revealed the controversy between the two involved which one of the two Charters would be sold and the terms under which that Charter would be conveyed.

“The Agreement entered between the parties identified Charter No. 36 as the sale charter for a purchase price of $45 million,” RWR’s countersuit stated. “Legacy has repudiated the Agreement by … claiming the Agreement was actually for Charter No. 27, seeking to enforce a sale of Charter No. 27 (including but not limited to filing a lawsuit), and refusing to perform the parties’ agreement for sale of Charter No. 36. This is a substantial alteration and breach of the parties’ agreement.”

This year, RWR uses one of its two Charters for its No. 51 entry of driver Cody Ware in NASCAR’s Cup Series. It has its second Charter leased to RFK Racing, which uses it for its No. 60 Ford driven by Ryan Preece.

Under the Charter agreement between the Cup teams and NASCAR, a Charter can be leased only once during the seven-year agreement. RWR planned to retake its Charter from RFK Racing at the end of the season and then lease its other Charter to RFK Racing for the 2026 season.
